PROHIBITIONOFCARRIAGEOFPASSENGERSONCERTAINFLIGHTS

An aircraft (aeroplane, helicopter, gyroplaneor airship) that carries a passenger

shall not engage in any of the following types of flying:

• flying training given to a personwho has not passed a general flying

progress flight test for aircraft of the category concerned;

• practice of emergency procedures in the aircraft;

• low flying practice;

• testing an aircraft or its components, power plant or equipment.

An aircraftwhile engaged in testingmay carry engineering andmaintenance

personnel who are required, as part of their duties, tobe present in

the aircraft during the flight for the purpose of flight observationor of

maintenanceof the aircraft, including any aircraft component installed in

the aircraft.

INTOXICATEDPERSONSNOTTOACTASPILOTSORTOBECARRIED

ONAIRCRAFT (CAR 256)

A person shall not, while in a state of intoxication, enter any aircraft.

A person shall not act as amember of an operating crewor be carried

for that purpose if his or her capacity to act is in anyway impaired by the

consumption or use of any alcoholic liquor, drug, pharmaceutical ormedicinal

preparation or other substance (CAR 256).

A person shall not act as, or perform any duties or functions preparatory to

acting as, amember of the operating crew of an aircraft if thepersonhas,

during theperiod of eight hours immediately preceding thedepartureof the

aircraft consumed any alcoholic liquor.

Apersonwho is onboard an aircraft as amember of theoperating crew, or as

a person carried in the aircraft for the purpose of acting as amember of the

operating crew, shall not consume any alcoholic liquor.
