• detain the passengers, crew and cargo for such period as the pilot
considers reasonably necessary to ensure compliancewith theAct or
theseRegulations in or in relation to the aircraft.
A personwho, on an aircraft inflight, whetherwithinor outsideAustralian
territory, is found committing, or is reasonably suspected of having
committed, or having attempted to commit, or of being about to commit, an
offence against theAct or theseRegulationsmay be arrestedwithoutwarrant
by amember of the crew of the aircraft in the samemanner as a personwho
is found committing a felonymay, at common law, be arrested by a constable
and shall be dealtwith in the samemanner as a person so arrested by a
constable.
RESTRICTIONOFADVERTISINGOFCOMMERCIALOPERATIONS (CAR210)
A person shall not give any public notice, by newspaper advertisement,
broadcast statement or any othermeans of public announcement to the
effect that a person iswilling toundertake by use of anAustralian aircraft any
commercial operations unless the last-mentionedperson has obtained anAir
Operator’sCertificate authorising the conduct of thoseoperations.
PRIVATEOPERATIONSCAR 2(7)(D)
The following are regarded as privateoperations:
• the personal transportation of the owner of the aircraft;
• aerial spottingwhere no remuneration is received by the pilot or the
owner of the aircraft or by any person or organisationonwhose behalf the
spotting is conducted;
• agricultural operations on land owned and occupiedby theowner of the
aircraft;
• aerial photographywhere no remuneration is received by the pilot or the
owner of the aircraft or by any person or organisationonwhose behalf the
photography is conducted;
