OPERATINGNEAROTHERAIRCRAFT (CAR 163)
An aircraftmust not be flown so close to another aircraft as to create a
collision hazard.
An aircraftmust not be operated on the ground in such amanner as to create
hazard to itself or to another aircraft.
FORMATION FLYING (CAR 163AA)
Aircraftmust not be flown in formation unless:
• each of the pilots in command is qualified to fly in formation;
• the formation is pre-arranged between thepilots in command; and
• the formationflight is conducted either:
– under theVFR by day; or
– under an approval given byCASA.
Unless otherwise approved byCASA, a pilot in command is qualified for
formation flight only if:
• the pilot has been certified by the holder of a flight instructor rating as
being competent to fly in formation, being a rating that is appropriate to
the category of aircraft tobe flown in the formation; and
• the certification is entered in thepilot’s logbook.
For thepurposesof this regulation, twoormoreaircraft areflown in formation if:
• they are flown in close proximity toeach other; and
• they operate as a single aircraftwith regard to navigation, position
reporting and control.
In determiningwhether aircraft are in close proximity to each other, regard
is to behad to the type of aircraft in the formation and the speed of those
aircraft.
In spiteof paragraph 3 above, aircraft are to be taken tobe in formation:
• during any periodwhen they aremanoeuvring to achieve separation from
each other in order to effect individual control; and
• during join-up andbreakaway.
