OVERTAKING (CAR 160)

An ‘overtaking aircraft’means an aircraft that approaches another aircraft

from the rear on a line forming an angle of less than70°with the plane of

symmetry of the latter, that is to say, an aircraft that is in such a positionwith

reference to another aircraft that at night itwouldbe unable to seeeither of

the forward navigation lights of the other aircraft.

RIGHTOFWAY (CAR161)

An aircraft that is required to keep out of theway of another aircraft shall

avoid passing over or under theother, or crossing ahead of it, unless passing

well clear.

An aircraft that has the right ofway shall maintain its heading and speed, but

nothing in the rules shall relieve the pilot in commandof an aircraft from the

responsibility of taking such action aswill best avert collision.
