INCIDENTS
The pilot in command, the owner, theoperator and thehirer (if any) are each
responsible for ensuring that awritten notificationof an incident, preferably
on anASIR, is forwarded toATSBwithin72 hours of the incident.
BIRDSTRIKE
BirdStrike is a collision between a bird, or a number of birds, and an aircraft.
All bird strikes inAustralia are incidents under Part 2A (S19AC) of theAir
NavigationAct 1920. The reporting of a bird strike, including a ‘nearmiss’ or a
hazardous situation, ismandatory, preferably using anASIR.
INVESTIGATION
The investigator of an accident or incident is empowered to demand such
evidence, documents and components as is required (Air NavigationAct
1920).
Copies of flight plans, logs and briefing documents shouldbe retained by the
pilot for 14 days after a flight in case theymay be required by the investigator.
CUSTODY
When an accident occurs, the aircraft is deemed to come into the custody
of theDirector of ATSB and itmust not be removedor interferedwith
exceptwith thepermission of theDirector or authorised representative
(Air NavigationAct 1920). However, under Part 2A (Division 7) of theAir
NavigationAct, the extrication of persons, animals ormails is permissible.
Further, rescuers are permitted to take such action as is necessary, to…
’protect thewreckage from further damage, and to prevent danger to aircraft,
other transport and the public’. Goods andbaggagemay only be removed
from thewreckage under the supervision of the policeor other authorised
officer. Additionally, on the case of an aircraftwhich has come from outside
Australia, the consent of aCustomsOfficer is required. On completion of the
investigation of an accident, the aircraftwill be released to the owner.
