QUALIFICATIONS FORNIGHT FLYINGUNDERVFR (CAR174C)

• Subject to this regulation, a person other than:

– in the case of agricultural operations—the holder of a licenceonwhich

a night VFR agricultural rating has beenendorsed; or

– in the case of any other flight—theholder of a licence onwhich a night

VFR ratinghas been endorsed; or

– a student pilot, or holder of a private pilot licence, a commercial pilot

licence or an air transport pilot licence, permitted under Part 5 to fly

an aircraft in a traffic pattern at night under theVFR; shall not fly an

aircraft at night under theVFR.

• Apilotwho holds a licenceonwhich an instrument rating for a category

of aircraft has been endorsedmay fly an aircraft of the same category at

night under theVFR:

– using the types of navigation aids endorsed in thepilot’s logbook for

usewith that rating; and

– subject to compliancewith any conditions that CASA issues inCivil

AviationOrders in relation to aeronautical experience and recent

experience.

In this regulation, a reference to flying an aircraft includes a reference to

conducting a flight as pilot in command.

VFR FLIGHTSATNIGHT (CAR 174B)

• Exceptwith thepermission of CASA, an aircraft shall not, exceptwhen

necessary for take-off or landing, beflown at night under theVFR at a

height less than1000 ft above the highest obstacle locatedwithin 10nm

of the aircraft in flight.

• A singleengine aircraftmust not beflown at night under theVFRexcept in

the following operations:

– private operations;

– aerial work operations;

– charter operations that do not involve the carryingof passengers for

hire or reward;

– charter operations that involve the carryingof passengers for hire or

reward, if:
