A private (helicopter) pilotmust not fly a helicopter as pilot in command if the
helicopter is carrying any other personunless:
• if theflight is undertaken indaylight—the pilot has, within theperiodof 90
days immediately before theday of theproposedflight, carriedout at least
3 circuitswhile flying a helicopter as pilot in command or as pilot acting in
command under supervision or in dual flying; and
• if theflight is undertaken at night—the pilot has, within the period of 90
days immediately before the day of the proposedflight, carriedout at
least 3 circuits at nightwhile flying a helicopter as pilot in command or as
pilot acting in command under supervisionor in dual flying.
Note: Under regulation 5.40, a personmust not fly as pilot acting in
command under supervision unless he or sheholds a commercial pilot
licence, an air transport pilot licenceor amulti-crewpilot (aeroplane)
licence.
For the purposes of this regulation, a person carries out a circuitwhile flying a
helicopter if theperson:
• takes-off in the helicopter from an aerodrome; and
• flies the helicopter around the aerodrome in accordancewith the traffic
pattern for the aerodrome; and
• lands the helicopter at the aerodrome.
In this regulation aerodromemeans a place that aircraftmay land at, or take-
off from.
