Quick question regarding planning non hemispherical to avoid freezing level and therefore icing in VH OZY. Refer the final online practice exam #4. I do understand the reference to CAR 238(1) that you can't plan to be in freezing conditions without anti or de icing etc... But just wondering why we couldn't plan to go at the LSALT of 5000 on the first leg? I understand it does not conform to the IFR hemispherical level but could you not request 5000 DUE OPERATIONAL REQUIREMENT as per ENR 1.7 3.1.2.1 and also note 3.2.1 later on that page? Og course due to conditions being worse then ENR 1.1 10.7.3.2 you'd have to provide an alternate but that doesn't mean you can't plan to TRY and get there in the hope you can do a visual approach?
Your help is much appreciated, I am very much enjoying the challenge of these practice exams.

CASA exams are pretty simple with this.
You [b]CAN'T [u]PLAN[/u][/b] to fly non hemispherical to avoid icing.
If you're already flying, then you can decend to the LSALT to avoid icing.

ENR 1.7-5 3.1.1 - Flight must be planned.....
3.1.2.1 - That is talking about in flight

They could only ask a question like this in two way
It will either be
You're PLANNING a flight A to B (east or west) LSALT is... Freezing is....
Just pick below freezing and above LSALT in hemispherical (or cant plan the flight)
OR
You're flying and encounter icing at.... LSALT is.... what should you cruis at
In this case you can come down to LSALT regardless if it's hemispherical or even a vfr cruising alt
